By downloading, installing, or using the Rushly mobile application ("App") in any manner, you acknowledge that you have read, understood, and agree to be bound by all provisions of these Terms of Service. These terms constitute a binding agreement between you and Rushly.
The App is rated 9+ according to App Store age ratings. Users under 13 may only use the App with the explicit consent and supervision of their parents or legal guardians; accounts cannot be created without parental consent. Users aged 13-17 are recommended to register with parental or guardian consent.
If you do not accept these Terms of Service, you must not download, install, or use the App. Your continued use of the App constitutes acceptance of the terms currently in effect.
Rushly is a comprehensive mobile application designed for AI-powered personal fitness and nutrition tracking. The App provides the following services:
- AI-powered personalized workout program creation and management
- AI-powered nutrition plans, calorie and macronutrient tracking
- Automatic nutritional value estimation through food photo analysis
- Barcode scanning for food information lookup and nutritional data display
- Body measurement tracking (weight, waist, neck, hip circumference, body fat percentage, muscle mass)
- Health data synchronization through Apple HealthKit and Android Health Connect integration
- GPS-powered activity recording (running, swimming, cycling, walking, hiking, and 23 different activity types)
- Personalized recommendations through AI coaching chat
- Sleep duration and quality tracking
- Muscle soreness logging and recovery tracking
- Visual progress tracking through progress photos (front, side, back)
- Apple Watch app and iOS widget support
- Personal record tracking and achievement badges
Rushly reserves the right to continuously improve the scope, features, and content of its services.
You must register with an email address or through your Apple/Google account to use the App. Users registering with email will receive an email verification code; certain features may be restricted until verification is completed.
You are solely responsible for keeping your account information accurate, complete, and up to date. You are obligated to keep your password secure, not share it with any third party, and choose a password of sufficient complexity.
You are exclusively responsible for all activities conducted through your account. In the event of suspected unauthorized access or a security breach, you must immediately notify us at support@rushly.com.tr.
The App optionally supports biometric authentication via Face ID and Touch ID. Biometric data is processed locally on your device and is not transmitted to Rushly servers.
IMPORTANT: Workout programs, nutrition plans, AI recommendations, calorie calculations, body analysis results, and all health-related content provided by Rushly are for general informational and educational purposes only. This content does not, under any circumstances, substitute professional medical advice, diagnosis, treatment, or dietitian/nutritionist consultation.
Always consult a healthcare professional (doctor, dietitian, or physiotherapist) before starting any exercise or diet program. If you have a chronic condition (diabetes, cardiovascular disease, hypertension, etc.), injury, pregnancy, or special health situation, you must obtain approval from your healthcare provider before applying any recommendations in the App.
Rushly cannot be held responsible for any health issues, injuries, nutritional disorders, or damages that may arise from decisions made based on information, AI recommendations, or content in the App. By using the App, you acknowledge and accept this risk.
The App provides algorithmic recommendations and content powered by the Google Gemini AI model. AI technology is continuously evolving, and the generated content is subject to certain limitations.
AI-generated workout programs, nutrition plans, food photo analyses, nutritional value estimates, and coaching chat responses may not always be accurate, complete, or up to date. Calorie and nutritional value estimates are approximate values; they should not be considered definitive results and do not substitute laboratory analysis.
Do not use AI responses as your sole or primary reference for health, nutrition, or exercise decisions. Always consult a healthcare professional for important health decisions.
You can fully control and change at any time which personal data the AI uses through the "AI Data Sharing Preferences" section in the App settings.
The App offers two tiers: free and premium. Free users are subject to daily and monthly usage limits (e.g., limited AI chat messages, food photo analyses, and plan creation allowances).
Premium subscription options:
- Monthly: $7.99/month
- Yearly: $44.99/year
A 7-day free premium trial may be offered to newly registered users. When the trial period ends, the account automatically reverts to the free tier if no subscription is purchased.
All subscription purchases are processed through the Apple App Store and are subject to Apple's payment infrastructure. Subscriptions automatically renew at the end of each period. Cancellation must be made at least 24 hours before the end of the current subscription period; otherwise, charges for the next period will apply.
No partial-period refunds are provided. Refund requests are subject to Apple's refund policies and are managed through Apple. Promotional codes are created by Rushly management and may be subject to specific usage limits, expiration dates, and terms of use.
All intellectual property rights, including all content, designs, graphics, logos, icons, user interface, software code, algorithms, AI model outputs, database structure, and the "Rushly" brand within the App belong exclusively to Rushly and are protected by national and international intellectual property laws.
Copying, reproducing, distributing, modifying, creating derivative works from, or using these materials for commercial purposes without authorization is strictly prohibited.
Users retain their ownership rights over personal data and content entered into the App. However, Rushly is granted the right to process this data for the purposes of service delivery, improvement, and personalization. This right is exercised within the conditions set forth in the Privacy Policy.
By using the App, you agree and undertake to comply with the following rules:
- Using the App for any unlawful, unauthorized, or purpose that violates these Terms of Service is prohibited.
- Using the App in a manner that may harm other users, third parties, or the Rushly infrastructure is prohibited.
- Attempting to bypass, disable, or test the App's security mechanisms is prohibited.
- Reverse engineering, attempting to access the source code, decompiling, or disassembling the App is prohibited.
- Using automated data collection tools (scraping, bots, crawlers) is prohibited.
- Creating accounts with false, misleading, or another person's information, or modifying account information in a deceptive manner is prohibited.
Violation of these restrictions may result in immediate suspension or permanent closure of your account.
Rushly reserves the right to modify, update, temporarily suspend, or permanently remove the App's features, functionality, pricing, usage limits, or interface with or without prior notice.
Service interruptions may occur due to scheduled maintenance, software updates, server migrations, or unforeseen technical issues. While Rushly exercises reasonable effort, no guarantee of uninterrupted service is provided.
Rushly cannot be held liable for any direct or indirect damages arising from service interruptions, data loss, or delays.
Users will be notified of significant changes that affect them through in-app notifications or email.
Rushly may temporarily suspend or permanently terminate accounts that violate these Terms of Service, misuse the App, cause harm to other users or the Rushly infrastructure, or engage in unlawful activities without prior warning.
You may delete your account at any time through the account settings section within the App. Following your account deletion request, your data will be permanently deleted within 30 days. During this 30-day period, you have the right to recover your account (cancel the deletion) within the first 7 days.
If you re-register with the same email address after account deletion, previously used free trial benefits will not be granted again.
The App is provided on an "as is" and "as available" basis. Rushly makes no express or implied warranties of any kind.
Rushly does not guarantee that the App will be uninterrupted, error-free, secure, or virus-free. The accuracy, completeness, or fitness for a particular purpose of content generated by AI is not guaranteed.
Rushly cannot be held liable for any direct, indirect, incidental, special, punitive, or consequential damages (including but not limited to loss of profit, data loss, loss of business, health issues, or injury) arising from the use or inability to use the App.
This limitation of liability applies to the maximum extent permitted by applicable law. Some jurisdictions may not permit certain limitations of liability; in such cases, liability is limited to the minimum extent permitted by the relevant law.
Rushly reserves the right to update these Terms of Service from time to time. Each update is tracked with a version number.
Minor changes: For corrections and clarifications that do not substantially alter the scope of service, in-app notifications will be sent. Your continued use of the App after notification constitutes acceptance of the updated terms.
Significant changes: For changes that substantially affect user rights, responsibilities, data processing scope, or subscription terms, at least 30 days' advance notice will be provided. Explicit re-acceptance (re-consent) is required for such changes. Users who do not provide re-acceptance cannot continue using the App; however, their rights to delete their account and export their personal data are preserved.
The current version of the Terms of Service is always accessible from the in-app settings section and at rushly.com.tr/legal/terms.
All matters relating to the collection, processing, storage, and protection of your personal data are governed by a separate Privacy Policy document. The Privacy Policy is an integral part of these Terms of Service and should be read in conjunction with the Terms of Service.
You can access the Privacy Policy from within the App or at rushly.com.tr/legal/privacy.
These Terms of Service are governed by and construed in accordance with the laws of the Republic of Turkey. The courts of the Republic of Turkey shall have exclusive jurisdiction over any and all disputes arising from or in connection with these terms.
The provisions of Consumer Protection Law No. 6502 are reserved for disputes within the scope of consumer rights.
